AND UPON the Petitioner/Respondent undertaking to the Court and agreeing within 28 days of being requested to do so to undergo such medical examination and provide such information as may be required from time to time by the insurers of New Start Maintenance Protection to enable the Respondent/Petitioner to insure her/his maintenance income against the Petitioner/Respondent's unemployment, disability, death and/or default on payment of the periodical payments as provided for under the terms of this order

IT IS RECORDED THAT this recital is authority for the release of medical records, notes and information in relation to the Petitioner/Respondent to the insurers of New Start Maintenance Protection so long as the Petitioner/Respondent is liable to maintain the Respondent/Petitioner under the terms of this order or following death of the Petitioner/Respondent as may be from time to time reasonably requested in accordance with the Access to Medical Reports Act 1988 at the cost of the Respondent/Petitioner

IT IS RECORDED THAT this recital is authority for the Petitioner/Respondent's employer, whether former or current, to release to the insurers of New Start Maintenance Protection so long as the Petitioner/Respondent is liable to maintain the Respondent/Petitioner under the terms of this order such information as may be from time to time reasonably requested at the cost of the Respondent/Petitioner View Clauses

So what does NewStart Cover?

Essentially New Start provides income protection cover for your maintenance.
  • DEBT RECOVERY AND LEGAL FEES - The debt recovery costs and legal fees of a family law solicitor to enforce your maintenance are covered.
  • LEGAL HELPLINE - Our confidential legal advice helpline, which is operated by Stones Solicitors LLP, puts you in touch with a qualified legal adviser who can give you general advice on any legal matter relating to your family.
  • ACCIDENT / SICKNESS/ ACCIDENTAL DEATH - If the maintenance payer cannot pay maintenance as a result of being unable to work through sickness, accident or accidental death, then your lost or reduced maintenance would be paid by the insurance.
  • REDUNDANCY - If maintenance is not paid due to redundancy of the maintenance payer, then the lost or reduced maintenance would be paid by the insurance.
  • DEATH (non-accidental) - If the maintenance payer dies by natural causes an income equivalent to the lost maintenance will be paid for a limited period.

What is not covered?

The policy documents give full details and you should read them (Key Facts and full policy conditions) but the main exclusions are listed here:

    • Waiting Period: You cannot claim within the first 30 days of disability or unemployment. After 30 days has elapsed, a claim can be made for lost maintenance back to the first day of disability or unemployment.
    • Suicide, attempted suicide, intentional self-injury of the maintenance payer or as a result of alcohol, drugs or solvent abuse
    • Acts coordinated between you and the maintenance payer for the purpose of creating a claim
    • Mental or psychiatric disorder of the maintenance payer unless he or she is sectioned under the Mental Health Act 1983
    • Any acts or omissions where you prejudice any legal action / recovery
    • Claims not submitted within 45 days
    • Claims that started or were known to be likely before the insurance began
    • Claims from pre-existing medical or physical conditions of the maintenance payer that you were aware of unless declared to underwriters
    • Claims where the maintenance payer has received notice of impending unemployment prior to the start of this insurance which you were aware of
    • Disability claims if the maintenance payer was not in full time employment or self-employment on the day before the disability started or whilst the maintenance payer was outside the UK for more than 30 days
    • Legal expense or Debt recovery claims within the first 90 days where the maintenance order was in force before the start of the insurance
    • Disability claims made within the first 30 day of this insurance or unemployment claims made in the first 90 days of this insurance

Maintenance Assist is the sole owner of the data collected on the website. We will not share your email address or any other personal information, submitted via this website to any third parties except in connection with the arrangement of New Start insurance. Some information is classified as sensitive personal information, for example, health details and criminal convictions. By taking out this policy you explicitly consent to its use and we may therefore share this as well as other personal data with insurers, their agents and insurance brokers. Disclosure to other parties will only be made if required by law to do so. You are protected by the Data Protection Act and have the right to request a copy of any information held about you by any of the above organisations. We will request the information on your behalf.
